1) Important note to all buyers regarding delivery:

If you do not have access to a forklift at your end, you must let us know upon purchasing the machine, since the machine is big and heavy. Peter Industrial Sewing Machines Pty Ltd doesn’t hold any responsibility for any fee or cover extra costs such as the tailgate, insurance, loss, or damage during and after transport by the purchaser and third party.

There are 2 options for you to choose from:

Option 1: you or your friend need to be there to give the driver a hand to load it off the truck, since you do not have access to a forklift, we will pack the machine as 2 separate parts, this way to reduce its weight so that you can carry it off easily.

Option 2: we can organize for a tailgate truck delivery to lower the parcel to the ground for you and from there you do need to bring it inside by yourself, the delivery man will not do it for you, this option will increase the delivery cost. So do select your suitable option and let us know. Regarding
machine arrived in a damaged state.

Due to the freight company will not offer insurance for second-hand goods, therefore, there will be no insurance, no warranty, no return, and no exchange for your purchase. The reason is once your item is taken over or under the care of the freight company, it is out of our control, we will take no responsibility for the item purchased by you regarding damaged, gone missing, or taking too long to arrive, you will have to deal directly with the freight company to sort it out. Having said that, it rarely happens but still, we do have to inform you about it. So please make up your decision carefully if these conditions stated above are not suitable for you, please do not proceed to buy our goods. We will always try our very best to pack your goods as best as we can. Please view our feedback for more information.

2) Regarding the machine’s repair, service, or warranty

You are only required to send down the part, eg: the sewing head, that needs repair at your own cost, not us, you don’t need to send us the whole machine.

We are not responsible for several problems during the warranty time such as:

• Broken needle causes sewing materials thicker than the maximum thickness level of the machine• Jamming thread, wrong threading, or timing out with regard to sewing mistakes or skills

• The machine hasn’t been able to turn on/ work after a long-time stored in your place and hasn’t been used (during or after the warranty)

• You don’t know how to use the machine (we will show you how to use it and the operation of the machine before you buy it)

• Set up or install parts if you change your mind after buying

• We are only responsible for the original setup, and operation of the machine and have no warranty for any modification. (if the machine is opened and in regard to any repairs or modification, which will lead to warranty void)

• Any problems such as broken or damaged if you do self-pickup and delivery, broken or damaged due to moving house, change of factory, and so on. The machine will only be recorded with the first delivery address. We will provide you with support about the information of machines before you buy the goods, during the warranty or after sale service.

• Exclusions include all consumable spare parts including, but not limited to bobbins, knives, feed dogs, throat plates, thread guides, loopers, rotary hook & base assemblies, or shuttles and switches. Limitations include service labor; approved warranty work will be covered for free service labor for a period of 14 months from the purchase/installation date. Travel time/expenses are also limited under the limited 14-month warranty term. Warranty and service labor is offered and provided to customers’ sites if within 50 km from the PISM office. Warranty for locations outside 50 km from the PISM office is deemed to be an “in dealer” or “back to base” warranty where the purchaser will be responsible for safely delivering or transporting the machine to a PISM office for approved warranty works to take place. The customer shall be responsible for all travel, transportation, and insurance costs associated with the warranty work under this term. Warranty excludes claims due to misuse, neglect, operator error, accident, unsuitable operation outside of the machine’s intended purpose and specification, general machine adjustments/settings including, but not limited to thread tension balancing, stitch length or foot pressure, or feed adjustments. Skip stitching and thread-breaking calls are subject to technician findings before the warranty claim can be approved. PISM may be entitled to recover costs for service labor and parts for non-approved warranty works depending on findings from the technician. The warranty also excludes additional re-training of operators for general machine adjustments and functions.

• Portable Sewing, Cutting, and Steam Iron Equipment All machines and equipment of a portable nature are supplied under an “in dealer” or “back to base” warranty term. Consumable parts for such equipment including, but not limited to cutting knives, sharpening stones, and heat elements are excluded.

3) Regarding the returning machine back to us

IMPORTANT NOTE: PLEASE REFER TO ALL PICTURES AND DESCRIPTIONS PROVIDE AS IT WILL BE THE TERMS AND CONDITIONS FOR YOUR PURCHASE. WE RECOMMEND YOU SHOULD CONTACT US BEFORE YOU PURCHASE.

If the machine is not working correctly or as described, we will refund you back for the cost of the machine only, not the purchased freight cost to you, and you must arrange your own freight to return the machine back to us, at your own cost, we will not pay for the return cost, and we will charge you for the repair if the machine arrived in a damaged state, due to careless packing. Consumer guarantees don’t apply if you:

• Simply changed your mind, found the product cheaper elsewhere, or decided you don’t like or need the product
• Misused a product and have caused or contributed to the failure of the goods, for example, by damaging or misusing the goods.
• If you purchase the machine on your own decision as well as through online channels without any contact to the seller’s advice. We won’t be able to process returns, refunds, and exchanges if the product is not suitable for your purpose.

4) Remote Support

PISM technicians will provide reasonable telephone or remote support to customers for fault
diagnostic and service issues. If the specific fault or query is deemed to require direct intervention, a Service Manager will assist in booking a service technician to assist with resolution. Some of our product lines provide for telephone or remote technical support to be purchased at a nominated cost, our representatives will advise should charges be necessary for remote support.

5) Limitations of Liability

In no event shall PISM be liable for any special, indirect, incidental, exemplary, or consequential, or punitive damages whatsoever, including, but not limited to, loss of business profits, even if PISM. is advised or should have known of the possibility of such damage or loss. The liability of PISM whether in contract, tort, under any warranty, or otherwise shall not extend beyond the limited warranties described herein.

6) Irrevocable Orders

PISM. reserves the right to withhold deposit funds on irrevocable or special orders where non-stocked items are specifically ordered on the purchaser’s behalf. Goods are to be determined as irrevocable orders by notation on the quotation or other correspondence from PISM. to the purchaser. The amount of funds withheld from the purchaser is to be determined by PISM. to reasonably cover any out-of-pocket expenses to carry unwanted stock ordered in good faith for the purchaser or cancellation penalties incurred by suppliers. The customer shall not cancel orders nor refuse acceptance of goods deemed to be irrevocable or special ordered.

7) Test Materials Often,

PISM. require an adequate quantity of test materials, samples, and threads for the setup, tuning, and testing of ordered equipment at our facility prior to delivery. The purchaser is responsible for all costs of test materials and associated transport costs to deliver the materials to our facility or nominated supplier address. PISM. will make reasonable efforts to minimize the use and waste of test materials and will return any unused test materials to the purchaser. Similarly, test materials may be required at the time of installation at the purchasers’ nominated site to be used for operator training of the equipment. The purchaser is responsible for all costs of test materials used for setting up, and training during and after installation day(s).

8) Spare Parts

Unless otherwise specified on the quotation, Tax Invoice, or other correspondence from PISM. spare parts are not included and are additional options.

9) Limited Warranty

PISM. represent a number of suppliers with a variety of products. Different suppliers and products often carry specific terms and conditions within the warranty, a list of common products and their associated warranty terms are listed below.

10) STORAGE AND LEAVE

You will have 7 days to store and leave the products in our place after purchase if the longer time you will need to inform us of the “in-dealer” agreement. Fee and charge will be applied for industrial sewing machines as storage space are $50 a week or $10 a day.

11) Acceptance

The Customer/Purchaser has read and understands these terms and conditions and hereby agrees that by entering into a purchase agreement, placing an order with PISM. for goods and/or services, or by applying for and being approved for a trading/credit account by PISM. the customer/ purchaser has accepted and will be bound by any and all of the terms and conditions herein. The purchaser also understands that any equipment supplied is considered industrial by design and not intended for general household or consumer use.
